My maple tree is looking poorly. How do I determine if it Is dying and If it should be removed.

It is impossible to tell from just that one picture of the trunk. It looks like there may be some damage to a part of the trunk but the real question is, what does the crown look like? Is it fully leafed out on all branches? Any dead branches? If the top looks good, the plant is still able to get water and nutrients out to the leaves and i would not worry too much. If the crown is sparse with lots of dead branches, there may be a lot of internal rot in the tree.

Yes, it sounds like your tree is on the way out. Any time there are dead branches, small, stressed leaves and poor leafing out, it signals this. There is not much to do to turn things around as there is likely a lot of internal rot already.
