thorn tree with red berries #366398

how can I kill this tree small or large. spreads like crazy has red berries right now

Thanks for the pictures!  Very helpful!  Your tree is a hawthorn tree in the Crataegus  family.  I'm not sure what color the flowers were, and the photos don't tell me whether there are spikes on the branches, all helpful information to get the species accurately defined.  But here's a link to get you started in defining that, once you know the characteristics.
