Tree leader not growing #255020

I have a maple tree roughly 8 feet tall that was planted last November. The tree leader is not growing and has no leaves. There are other branches that are not growing leaves. See photo. Should this tree be replaced? What happens if the leader with no leaves is trimmed?

My recommendation is to prune out the dead branches (those branches that don't have leaves).  The tree may attempt to develop one or more new leaders.  If two or more leaders develop, remove all but one within one to two years. 

I would also remove the stakes on the tree.  The stakes are not necessary. 

If given a chance, the tree may still develop into an attractive specimen.
