permanent custody of grandkids in a D&N case in Colorado when grandparents are out of state #233250

I'm looking for some advice about a proposed custody order from the GAL office. They are proposing permanent custody go to us the grandparents with restrictions for the father's visitation. Both parents filed for divorce and no charges are pending against the mother the father is facing possible military court martial. GAL office made no mention of joint custody with mother and grandparents. We have had the grandchildren for almost 12 months should we petition the court for custody with our terms and not the GAL office's terms. This has been a long year battle with the GAL office. We also currently have temporary custody! Not sure how to proceeded as funds are now becoming limited. we are planning on moving back to our state of residence of NY with the grandchildren.

I've checked with our specialist but she doesn't feel qualified to offer legal advice.  Her suggestion was to contact the Colorado Bar Association and ask these questions to them. http://www.cobar.org/

You should also contact the Colorado Department of Human Services – Kinship Department http://www.cokinship.org/ to see if they can assist you with finding free or reduced rate legal services. Further, New York has a pretty strong kinship program and you may want to look into the state services before they move there.

Hope this is helpful and good luck! Thanks! Ruth
